At 9 a.m. Saturday, October 5, 2024, Bob Weiss, Maryann Weiss, Clay Rogers and myself, Angela Woodruff, were all in attendance of a special meeting I requested to present Bob and Clay with the letter from the Covenants Committee of Residence.
First, I presented the letter from the committee requesting for the revised Covenants to be sent for review (see below) by an attorney.
Next, I presented a letter to the Board in support of halting all violations specifically for the items the community requested change (view the Oct 5: Letter to Suspend Fines During Covenants & Restrictions Review Process). This halt would specifically pertain only to the sections under review, for the remainder of the year, through voting. Upon voting, fines for the newly voted-upon Covenants will immediately proceed following community notification. I signed in support to halt, leaving the option to Bob and Clay.
Bob and Maryann immediately disagreed. They have a strong passion and do not support stopping fines for the existing Covenants' fines until the process and vote have concluded. They were in complete disagreement, did not support this request, and both decided to resign from their volunteer community positions as President and Director of the Beautification Committee. Following their verbal resignations, Bob Weiss physically dropped all Presidential legal possessions to Clay Rogers, and Maryann Weiss physically dropped all BCA community-related Beautification Committee items to the driveway of Angela Woodruff. They both they have relinquished everything they claim they have in possession of the HOA.
I have requested a formal letter of resignation from both parties, both verbally and via text message through point of contact Maryann Weiss, be sent to bcaboardsec.2024@gmail.com.
Effective immediately, due to the resignation of President Bob Weiss, Clay Rogers, Vice President, will perform all duties of the President and is vested with all the powers of the President.

Letter from the Committee: Proposal for Changes to Covenants & Restrictions
Dear Members of the BCA Board,
We hope this letter finds you well. As members of the Briarwood Community Association (BCA) and representatives of the BCA Sub-Committee on Covenants and Restrictions, we are writing to present a set of proposed changes to our current covenants and restrictions for attorney review. We request legal of our language for the 2024-2025 update prior to community voting. These proposals have been carefully considered and developed with the goal of enhancing our community's quality of life, property values, and overall harmony.
As a committee incorporating community feedback, we revised the following covenants and restrictions sections and subsections:

These proposed changes have been discussed in detail within the sub-committee, and we believe they reflect the evolving needs and preferences of our community members. We have also gathered feedback from a significant number of residents, who have expressed their support for these updates.
Through the process of reviewing community feedback and amending changes to the current covenants and restrictions, we realized we needed legal counsel for two points in the process.
We need legal review on the proposed covenant language in the above-listed sections and/or subsections for cohesiveness and legal terminology.
We encountered several redundancies regarding language on fines and fees, see section 27, throughout the document. We realized that amending the document for these redundancies and total document cohesion fell outside of the scope of work of this subcommittee and will require further legal counsel. Please advise via legal counsel on how to best reformat and streamline the document post-voting.
Upon return from the attorney, we intend to develop ballots that will enable residents to vote on individual subsections within each respective section. We believe this mechanism in the balloting process will allow the collective voice of the community to be heard. Upon completion of the ballots, we will host a community town hall to present the proposed changes and the proposed balloting.
